1. Definitions

In these Terms & Conditions, the following words and phrases shall have the meanings set out below, unless the context clearly requires otherwise:

• "ph38," "we," "us," "our" refers to the operator of the ph38 platform at ph38.cam.
• "Platform" means the ph38 website, mobile web interface, and all related gaming services accessible at ph38.cam.
• "Player," "you," "your" refers to any individual who accesses the Platform, creates an account, or places any wager.
• "Account" means the individual member account created by a Player upon successful registration and KYC verification on the Platform.
• "Real Money Balance" means the verified deposited funds held in a Player's Account, net of any wagering activity.
• "Bonus Balance" means any promotional credits, free spins, cashback, or reload funds credited to a Player's Account that are subject to separate bonus terms.
• "KYC" (Know Your Customer) refers to the identity and age verification process required before full account activation and withdrawal processing.
• "PHP" or "₱" means Philippine Peso, the sole currency used for all transactions on the Platform.
• "Prohibited Jurisdiction" means any country or territory from which access to real-money online gambling is prohibited under applicable law.

2. Acceptance of Terms

By accessing the ph38 Platform, registering an Account, making a deposit, or placing any wager, you unconditionally accept these Terms & Conditions in full. If you do not agree with any part of these Terms, you must immediately cease using the Platform.

These Terms constitute the entire agreement between you and ph38 with respect to your use of the Platform and supersede all prior agreements, representations, or understandings. ph38 reserves the right to amend these Terms at any time. Continued use of the Platform after any amendment constitutes acceptance of the revised Terms.

3. Eligibility

To register and maintain an Account on ph38, you must at all times satisfy all of the following eligibility criteria:

1. You are at least 21 years of age — the minimum legal age for casino-style gambling in the Philippines under applicable PAGCOR regulations.
2. You are a natural person and not a corporation, trust, or other legal entity.
3. You are physically located in the Philippines and not accessing the Platform from a Prohibited Jurisdiction.
4. You are legally permitted to participate in online gambling under the laws of the jurisdiction in which you are located at the time of play.
5. You are not accessing the Platform in your capacity as a professional or amateur player for the purposes of evading gaming taxes or obligations.
6. You have not previously had an Account suspended or terminated by ph38 for breach of these Terms.
7. You are not an employee, director, officer, or immediate family member of ph38 or any of its affiliated game providers or payment partners.

ph38 reserves the right to request documentary proof of eligibility at any time. Failure to provide satisfactory proof within a reasonable time may result in Account suspension and withholding of pending withdrawals pending investigation.

4. Account Registration & KYC Verification

4.1 Registration

To access real-money gaming on ph38, you must complete the registration process by providing a valid Philippine mobile number, a valid email address, and a secure password. You warrant that all information provided during registration is accurate, complete, and current. Providing false or misleading information is a material breach of these Terms and may result in immediate Account termination without recourse.

4.2 Know Your Customer (KYC)

In compliance with applicable anti-money laundering (AML) regulations and PAGCOR requirements, ph38 requires all players to complete identity verification before withdrawals are processed or accounts are fully activated. KYC verification requires submission of:

• A clear photograph or scan of a valid Philippine government-issued ID (PhilSys ID, driver's license, SSS/UMID card, or Philippine passport).
• A selfie photograph holding the submitted ID, upon request.
• Proof of payment method ownership (e.g., screenshot of GCash account registered in your name) for certain withdrawal thresholds.

4.3 One Account Policy

Each individual may hold only one ph38 Account. Operating multiple accounts — whether under the same or different personal details — is strictly prohibited. Where duplicate accounts are identified, ph38 reserves the right to close all associated accounts, forfeit all balances including winnings, and report the matter to relevant regulatory authorities.

5. Account Security

You are solely responsible for maintaining the confidentiality of your ph38 login credentials. You must not share your username, password, or account access with any third party. ph38 will not be liable for any loss or damage arising from your failure to maintain credential security.

If you suspect unauthorized access to your Account, you must notify ph38 support immediately via live chat or email. ph38 recommends enabling two-factor authentication (2FA) on your Account as an additional layer of security.

6. Deposits & Withdrawals

6.1 Deposits

All deposits to your ph38 Account are processed in Philippine Peso (PHP). The minimum deposit amount is ₱100. Accepted deposit methods include GCash, Maya, BPI, BDO, Metrobank, Visa, Mastercard, USDT TRC20, Coins.ph, and 7-Eleven payment channels. Deposit processing times vary by method; e-wallet deposits (GCash, Maya) are generally reflected instantly.

ph38 does not accept deposits from third-party accounts. Funds must originate from a payment method registered in your own name. Deposits received from unverified or mismatched sources may be held pending investigation and returned to the originating account at ph38's discretion.

6.2 Withdrawals

Withdrawals are available to fully KYC-verified players only. The minimum withdrawal amount is ₱200. Withdrawals to GCash and Maya are typically processed within 5–15 minutes during normal operating hours. Bank transfers (BPI, BDO, Metrobank) may take 1–3 business days. ph38 reserves the right to request additional verification documentation before processing any withdrawal request.

Withdrawals must be made to a payment method registered in your own name. ph38 will not process withdrawals to third-party accounts under any circumstances. Players may be subject to a maximum daily withdrawal limit; current limits are communicated within your Account dashboard.

6.3 Anti-Money Laundering

ph38 is required to comply with Philippine AML legislation. Unusual or suspicious transaction patterns may trigger an AML review, during which withdrawals may be temporarily suspended. ph38 reserves the right to report suspicious activity to the Anti-Money Laundering Council (AMLC) as required by law.

7. Bonuses & Promotions

ph38 offers a range of bonuses and promotional offers to eligible players, including welcome bonuses, reload bonuses, cashback, free spins, and VIP rewards. All bonuses are subject to the following general conditions, in addition to any specific terms published with each individual promotion:

• Bonuses are available to players who have completed KYC verification, unless otherwise stated.
• All bonus funds are subject to wagering requirements that must be fulfilled before the bonus amount or any winnings derived from it can be withdrawn. Wagering requirements are specified per promotion.
• ph38 reserves the right to withdraw any bonus offer, modify its terms, or cancel a player's bonus balance if there is evidence of bonus abuse, exploitation, or bad-faith play (e.g., hedging bets across opposing outcomes, systematically low-variance play designed to meet wagering requirements with minimal risk).
• Bonuses cannot be transferred, exchanged for cash, or combined with other promotional offers unless explicitly stated.
• ph38 reserves the right to amend or discontinue any promotional offer at any time without prior notice.

8. Rules of Play

All games offered on the ph38 Platform use certified Random Number Generator (RNG) technology or live dealer systems provided by licensed third-party game suppliers. Game outcomes are random, fair, and not influenced by ph38 or any third party outside the normal operation of the game engine.

By placing a bet on any game at ph38, you accept the specific rules of that game as published within the game interface. In the event of a dispute regarding game outcomes, the game server's records shall be the definitive source of truth. ph38 is not responsible for errors caused by a player's own device, browser, or internet connection.

ph38 reserves the right to void any bet that was placed in error, placed on an event where a technical malfunction occurred, or placed using funds that were credited to an Account in error. Where bets are voided, the wagered amount will be returned to the player's Real Money Balance.

9. Prohibited Conduct

The following activities are strictly prohibited on the ph38 Platform and constitute material breaches of these Terms:

• Creating or operating more than one ph38 Account.
• Using automated software, bots, scripts, or artificial intelligence tools to interact with the Platform or any game.
• Colluding with other players to gain an unfair advantage in any game.
• Exploiting any software bug, glitch, or technical error on the Platform.
• Engaging in bonus abuse, including creating accounts solely to claim bonuses with no genuine gaming intent.
• Attempting to use the Platform for money laundering, fraud, or any other illegal financial activity.
• Providing false or misleading identity information during registration or KYC verification.
• Accessing the Platform using a VPN, proxy, or other technology to mask your true geographic location.
• Engaging in chargebacks or payment reversals after funds have been used for genuine gaming activity.

ph38 reserves the right to suspend or permanently terminate any Account found to be engaged in prohibited conduct and to withhold any balances or pending withdrawals pending investigation. ph38 may report prohibited conduct to relevant law enforcement or regulatory authorities where legally required.

10. Responsible Gaming

ph38 is committed to the promotion of responsible gaming for all Filipino players. ph38 provides the following tools to help players manage their gaming activity:

• Deposit Limits: Players may set daily, weekly, or monthly deposit caps from their Account settings. Limits take effect immediately when reduced and after a cooling-off period when increased.
• Session Time Limits: Players may configure time-based alerts to notify them when a pre-set gaming session duration has been reached.
• Self-Exclusion: Players may request temporary self-exclusion for periods of 24 hours, 7 days, or 30 days, or permanent self-exclusion, at any time through Account Settings or by contacting ph38 support. During a self-exclusion period, the affected Account will be suspended and the player will be prevented from registering new accounts.
• Reality Checks: Periodic on-screen notifications remind players of the time elapsed during a gaming session.

Players who believe they may have a problem with gambling are encouraged to use these tools and to seek assistance. ph38 supports the responsible gaming initiatives of PAGCOR and encourages affected players to consult available Philippine support resources.

11. Intellectual Property

All content on the ph38 Platform — including but not limited to the ph38 brand name, logo, trademarks, game graphics, software, source code, user interface design, text, and images — is the intellectual property of ph38 or its licensed providers. All rights are reserved.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial gaming purposes only. You may not copy, reproduce, distribute, republish, download, display, post, transmit, or create derivative works from any content on the Platform without ph38's prior written consent.

12. Limitation of Liability

To the fullest extent permitted by applicable Philippine law, ph38 shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of, or inability to use, the Platform — including but not limited to loss of data, loss of revenue, loss of profits, or loss of gaming opportunities caused by service interruptions, technical failures, or third-party network issues.

ph38's total aggregate liability to any individual player in respect of any claim arising from these Terms or your use of the Platform shall not exceed the total amount deposited by that player in the thirty (30) days preceding the event giving rise to the claim.

Nothing in these Terms limits ph38's liability for fraud, gross negligence, or any liability that cannot be excluded or limited under applicable Philippine law.

13. Suspension & Termination

ph38 reserves the right to suspend or terminate any Account at any time, with or without notice, for any of the following reasons:

• Breach of any provision of these Terms & Conditions.
• Failure to complete KYC verification within a reasonable time following a request.
• Suspected fraudulent, deceptive, or criminal activity.
• Regulatory or legal requirement.
• Inactivity — accounts with no login activity for a period of 12 consecutive months may be flagged as dormant and subject to closure per applicable regulatory requirements.

Upon termination for cause, any Real Money Balance remaining in your Account will be subject to review. Where no breach is found following investigation, verified Real Money Balances will be returned to the player via their last verified payment method. Bonus Balances are forfeited upon Account termination.

You may close your ph38 Account at any time by contacting our support team. Voluntary Account closure will not affect any pending withdrawal requests made prior to the closure request.

14. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or in connection with these Terms shall first be submitted to ph38's internal dispute resolution process by contacting customer support.

If a dispute cannot be resolved through ph38's internal process within thirty (30) days, you may escalate the matter to the relevant Philippine regulatory authority. Both parties agree to make reasonable good-faith efforts to resolve disputes before initiating any formal legal proceedings.

15. Changes to These Terms

ph38 reserves the right to update, modify, or replace any part of these Terms & Conditions at any time. Material changes will be communicated to registered players via email or an in-platform notification at least seven (7) days before taking effect, where practicable.

Your continued use of the ph38 Platform after any changes to these Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically. The "Last updated" date at the top of this page reflects when the most recent revision was made.
